Purpose:

This policy aims at ensuring that staffing is maintained at establishment requirements and the employment of employees is protected wherever possible.

Policy:

When it appears to the Director that a staff member is excess to an establishment's requirements, the Director shall implement steps to redeploy the staff member to another position within the System.

Definitions:

Excess staff member means a staff member:

  • who is included in a class of staff members in an area of employment, which class comprises a greater number of staff members than is necessary for the efficient and economical working of a school or establishment;
  • whose services cannot be used effectively because of technological or other changes in the work methods of the school or establishment, or changes in the nature, extent or organisation of the functions of the school or establishment.

Procedures:

1. Where it appears to the Director that a staff member is likely to be excess to an establishment's requirements, the Director shall immediately provide all relevant details to the relevant union and arrange discussions with that union. Communication shall include discussion of:

  • measures that could be taken to remove or reduce the incidence of staff members becoming excess; eg. retraining;
  • redeployment prospects for the staff members concerned;
  • the appropriateness of using voluntary retrenchment; and
  • the method of identifying staff members as excess, having regard to the efficient and economical working of the school or establishment and the relative efficiency of staff members.

These discussions shall take place over such time as is reasonable having regard to the particular matters under discussion and to the need for potential excess staff situations to be resolved quickly.

2. Subject to discussion between the parties as set out above, where it is agreed that a staff member is, or a number of staff members are, excess to requirements in a school, placement in a similar position or positions at another school within the Catholic Archdiocesan Schools conducted by the CEO will be sought as follows:

  • the CEO will advise the union of vacancies, or prospective vacancies, at schools in the Archdiocese;
  • all staff members at the school within the class of staff members in which the excess has occurred, will be advised of all permanent and temporary vacancies, or prospective vacancies, and expressions of interest in redeployment to any of the vacancies sought;
  • where there are two or more applicants for the same vacancy, consideration should be taken of experience in the work associated with the vacancy and length of service;
  • where the number of vacancies, or prospective vacancies, exceeds the number of excess staff members at a school or establishment, the staff member will be redeployed to the vacancy of the staff member's choice wherever possible.

3. In the event that a redeployment is not possible, the redundancy policy will be implemented.
